This document contains all policies governing the use of the Cursed Earth Studios website, the purchase of products, and the Velvet Obscura Ink Edition subscription service. 1.  Terms & Conditions

1.1  Agreement to Terms

By accessing or using the Cursed Earth Studios website and by purchasing any product or subscription offered therein, you agree to be bound by these Terms and Conditions. If you do not agree, you may not use this website or purchase from this store.

 

1.2  Age Requirement

You must be at least 18 years of age to place an order, purchase products, or subscribe to any service offered by Cursed Earth Studios. By completing a purchase, you confirm that you meet this age requirement. Cursed Earth Studios reserves the right to cancel any order suspected of being placed by a minor.

 

1.3  Intellectual Property & Copyright

All artwork, designs, illustrations, graphics, branding, logos, and creative works displayed on or sold through this website are the original, sole intellectual property of Cursed Earth Studios and its owner.

 

The following rights are expressly retained by Cursed Earth Studios and are NOT transferred to the buyer upon purchase:

• Copyright and ownership of all underlying artwork and designs

• The right to reproduce, display, distribute, license, or create derivative works from any design

• All trademark and brand rights associated with the Cursed Earth Studios name and logo

 

Purchasing a physical or digital product grants you a personal, non-commercial license to own and display that specific item. It does not grant you:

• The right to reproduce, copy, or reprint the design in any format

• The right to sell, redistribute, or sublicense the design

• The right to use the design for commercial purposes of any kind

• Any claim of ownership over the design, brand, or underlying artwork

 

All designs sold by Cursed Earth Studios are original works and are not public domain. Unauthorized reproduction or commercial use of any design constitutes copyright infringement and may result in legal action.

1.4  AI Training Prohibition

Cursed Earth Studios explicitly prohibits the use of any artwork, design, video, photograph, or other creative content published on this website or associated social media accounts for the purpose of:

• Training, fine-tuning, or developing artificial intelligence or machine learning models of any kind

• Dataset collection or aggregation for AI systems

• Generating or reproducing designs using AI image tools, generative models, or similar technologies

• Any commercial or non-commercial reproduction via AI-assisted means

This prohibition applies to all content regardless of whether it is watermarked, behind a paywall, or publicly visible. By accessing this website, you agree not to use any content for the above purposes.

1.5  Fan Art & TCG Content Notice

Some designs sold by Cursed Earth Studios are inspired by or created as fan art for the Magic: The Gathering trading card game. Cursed Earth Studios does not claim ownership over any Magic: The Gathering intellectual property, card names, or game mechanics, which remain the property of Wizards of the Coast. These products are unofficial fan creations and are not affiliated with, endorsed by, or sponsored by Wizards of the Coast or Hasbro.

1.6  Product Descriptions

Cursed Earth Studios makes every effort to accurately represent products. However, colors may vary slightly due to monitor calibration, printing variation, and photographic lighting. These variations are not considered defects.

1.7  Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Illinois, United States.

1.8  Changes to Terms

Cursed Earth Studios reserves the right to update these Terms at any time. Changes will be posted to this page with an updated effective date. Continued use of the website constitutes acceptance of the revised terms.

Cursed Earth Studios is committed to protecting your privacy. This Privacy Policy explains what information is collected when you visit this website or make a purchase, how it is used, and your rights.

2.2  Information Collected

When you make a purchase or subscribe, you may provide:

• Your name and mailing address (required for physical shipment)

• Your email address

• Payment information (processed securely through Wix Payments or Patreon — Cursed Earth Studios does not directly store your payment details)

Information Collected Automatically

This site may automatically collect non-personally identifying information including browser type, pages visited, time on site, and referring URL. This is used only to understand how visitors use the site.

2.3  How Your Information Is Used

Your information is used exclusively to:

• Process and fulfill your order or subscription

• Ship physical products to your provided mailing address

• Contact you regarding your order or shipping status if necessary

• Improve the website and product offerings based on general usage data

Cursed Earth Studios does not sell, rent, trade, or otherwise share your personal information with third parties for marketing or commercial purposes.

2.4  Third-Party Services

This website is hosted on Wix. Transactions may be processed through Wix Payments or Patreon. These third parties have their own privacy policies, and Cursed Earth Studios encourages you to review them. Cursed Earth Studios does not control and is not responsible for the data practices of these platforms.

2.5  Mailing Address Data

Physical mailing addresses collected for the snail mail subscription are used solely to deliver your subscription package. Your address will not be shared with any third party other than USPS for delivery purposes.

2.6  Data Retention & Your Rights

Order and subscription information is retained as long as necessary to fulfill legal and operational obligations. You may request access to, correction of, or deletion of your personal data at any time by contacting us through the website. We will respond to requests within a reasonable timeframe.

2.7  Children's Privacy

This website is not directed at individuals under the age of 18. Cursed Earth Studios does not knowingly collect personal information from minors.

3.  Shipping Policy

Effective Date: March 2026

​

3.1  Processing Time

All orders are processed and shipped within 14 business days of the order date. Orders placed on weekends or holidays will begin processing the next business day.

​

3.2  Shipping Carrier

All orders ship via the United States Postal Service (USPS). Expedited shipping is not currently available. Cursed Earth Studios is a small independent studio and appreciates your patience.

​

3.3  Domestic Shipping Only

Cursed Earth Studios currently ships within the United States only. International shipping is not available at this time.

​

3.4  Velvet Obscura Ink Edition Subscription Shipping

Monthly subscription packages ship on the following schedule:

• Subscriptions open on the 1st of each month

• The subscription cutoff date is the 20th of each month

• All packages for a given month are packed and mailed between the 20th and the end of that month

• Subscribers who join after the 20th will be included in the following month's shipment

Please ensure your mailing address on Patreon is accurate and current. Cursed Earth Studios is not responsible for undeliverable packages due to incorrect subscriber-provided addresses.

3.5  Damaged Packages

If your order arrives damaged, please:

• Photograph the damage clearly, including both the packaging and the item(s)

• Contact Cursed Earth Studios within 7 days of delivery with photos and your order information

• Cursed Earth Studios will review and, at its discretion, offer a replacement for documented shipping damage

Cursed Earth Studios is not responsible for damage occurring after confirmed delivery.

3.6  Lost Packages

If your package has not arrived within 21 days of shipping confirmation, please contact us. We will do our best to investigate with USPS, though Cursed Earth Studios cannot guarantee replacement of packages confirmed as delivered by the carrier.

4.  Refund & Return Policy

4.1  Art Prints — No Returns

Art prints, 5x7 prints, 4x6 cards, and all flat printed artwork are non-returnable and non-refundable once delivered. Due to the reproducible nature of printed goods, Cursed Earth Studios cannot accept returns on printed items. Please review your order carefully before purchasing.

The only exception is items damaged in shipping. See Section 3.5 for the damage claim process.

4.2  Playmats & Physical Products — 30-Day Returns

Playmats and other non-print physical products may be returned within 30 days of the delivery date, provided:

• The item is in its original, unused condition

• The item shows no signs of use, damage, or alteration

• You contact Cursed Earth Studios before returning the item to confirm eligibility

Return shipping costs are the responsibility of the buyer unless the return is due to a Cursed Earth Studios error. Approved refunds will be issued to the original payment method within 7-10 business days of receiving the returned item.

​

4.3  Velvet Obscura Subscription Cancellation

The Velvet Obscura Ink Edition subscription is managed through Patreon. The following cancellation terms apply:

• You may cancel your subscription at any time through your Patreon account settings

• Cancellation on or before the 20th of the month: you will not be charged for that month and will not receive that month's package

• Cancellation after the 20th: payment for that month has already been processed and your package has been prepared or mailed. You will receive that month's package and will be removed from all future billing and shipments

• No partial refunds are issued for subscription packages that have already been prepared and mailed

Subscription packages are non-returnable due to the curated nature of their contents.

​

4.4  Order Errors

If you receive an incorrect item due to a Cursed Earth Studios error, contact us within 7 days of delivery with a photo of the incorrect item. We will arrange a replacement at no cost to you.

4.5  Digital Products

All digital product sales are final. No refunds are issued for digital downloads once the file has been accessed or delivered.
